Buyer and Seller Agency are described on our web site. More and more, Listing a Buyer is becoming a common practice. First it establishes a legal relationship where duties are owed and allegiance is defined. A Buyer's agent is a professional and works solely in your best interest. They have to provide professional expertise, due diligence and a higher degree of accountability. Like all professionals they have to be compensated. An agreement spells out what and how this compensation is to be paid. In Real Estate, all listed properties and many For Sale by Owners; the Sellers provide the compensation and nothing is due from the Buyer. The Buyer's Broker works for the Buyer and at the direction of the Buyer. For more information on what a Buyer's Broker does, please check out Buyer Representation on this site. If you would like Representation, both Cyndee and I are Accredited Buyers Representatives by REBAC and the National Association of Realtor's, please read and fill out the contract below, sign and return to us. At that point we will contact you, discuss your needs and get to work for you. We want your business, we wrote this site to show you that we were willing to earn it.
BUYER REPRESENTATION LISTING CONTRACT
In consideration of the mutual agreements herein contained, the undersigned Buyer(s) and Broker agree as follows:
The Buyer(s) Agrees:
1) To and by this agreement does give the Broker sole and exclusive right to represent the Buyer(s) and assist them in finding, negotiating and financing real estate.
2) Buyer request that the Broker select, prepare and complete documents allowed by Iowa or Illinois law to achieve their acquisition goals.
3) Buyer shall indemnify and same and hold REALTOR AND REALTOR'S agents harmless from all claims, disputes, litigations, judgments and costs arising from any misrepresentations made by Buyer.
4) Buyer understands that earnest money will be deposited with the listing Broker per custom or as directed per contract to purchase pending approval of the Title or Abstract and execution of final papers. Any contingencies to the offer not met, will result in the contract being null and void and earnest money will be refunded to Buyer.
5) Possession will be per the offer, generally at Closing or no later than two days after closing.
6) Buyer agrees to pay said Broker a brokerage fee of 3% or $_________, whichever is greater of the purchase price. This amount will be offset by any compensation received by Buyer's Broker from the Listing Broker or Seller. In the property is listed and compensation is provided by the Seller, the Buyer compensation will be the same as that paid by the Seller's Broker and no additional compensation will be due from the Buyer. Compensation may be written into offer, or price adjusted to reflect offset to cover Buyer Broker's compensation. Compensation shall be due if Buyer purchased the property through the Buyer's Broker, from another company or through any Seller during the listing period or within 200 days to anyone the Buyer was introduced to by the Buyer Broker during the listing period.
7) Upon expiration of this contract, the signing of another exclusive agency contract with any other Real Estate Broker will terminate the contractual relationship and all rights of the undersigned Broker except for the properties introduced during the listing period and covered in the protection period agreement.
8) An exchange is considered a purchase within the meaning of this contract. Broker may represent and receive compensation from both parties to a transaction, but only if disclosed to and agreed by both parties in writing.
9) Buyer agrees to contact their Agent immediately if they see or hear of any property to which they may have interest, so their Buyer's Representative may obtain the requested information or set up a showing for the Buyer. This may be any property listed by any other Broker, a For Sale by Owner or listed on any National Web site.
10) Buyer agrees to contact their Agent of any Open Houses they attend or have interest in, so Agent can immediately take them back through to look for defects or assist in assessing the true value of the property. Buyer's Agent will do a comprehensive market analysis on any properties the Buyer may have interest in, if the Buyer request it or if there is any doubt as to market value.
11) Buyer will have access to Buyer's Agent Web site and the tools there available to assist them in their decision making and education.
12) Buyer will contact the Buyer's Broker if there are any problems with their representation. If Broker is unable to cure said problem within five days, the Buyer will have the option to terminate this contract. Problem and termination both must be in writing and signed by both parties.
13) Buyer agrees to go to a lender of their choice and to get pre-qualified for their purchase within 7 days of this agreement.
14) Buyer agrees to sit down with Buyer's Agent and outline their property needs, including amenities, desired location and price. To educate the Buyer, Buyer's agent will provide Buyer's with listings from all companies and that fall within 10% up and down in price from their target, and close to their desired amenities. Regular updates will be provided as long as the Buyer is ready, willing and able to purchase within the listing period. Furthermore to notify Buyer's agent immediately if their parameters for acquiring a property change.
15) Buyer agrees to view properties at their convenience and by appointment for the purchase of finding a property that fits their needs.
THE BROKER AGREES:
1) To endeavor diligently to procure a property for the Buyer regardless of the listing source or compensation.
2) To furnish at all times any data requested by the Buyer, and to show any property the Buyer is qualified for by appointment.
3) Buyer's Agent will only represent the Buyer in a transaction, unless the property is listed by the Buyers's Agent and in that event, the Buyer will be notified of the conflict, the limitations of Dual Agency have been discussed and Buyer may agree to Duel Agency in writing if acceptable, or may have Buyer Agent's Broker represent them, prepare and present their offer.
4) Broker's Agency Policy is Designated Agency where one agent represents the interest of their client. All other agents of the company and other companies are deemed to be working for their clients per their listing contracts.
5) Buyer's Agent will work in the best interest of the Buyer at all times and at their direction as long as the Buyer's instructions are not contrary to Federal or State Law.
